This is NOT official legal advice! In this updated video, Sarah discusses what your tax obligations are as a dropshipper after the Wayfair vs. South Dakota Supreme Court ruling. This video is relevant for the following types of sellers: * They are sourcing items from Chinese dropshippers, such as Aliexpress dropshippers. * They are selling to customers that are based in the USA. Please note, on this channel we only focus on teaching new dropshippers how to focus on the USA market, which is why we will only discuss your tax obligations when selling to USA based customers. ***What Taxes Do I Need to Pay?*** When dropshipping you there are 2 types of taxes to pay: 1) Income tax 2) Sales tax ***Who Do I Pay Income Tax To?*** You pay income tax to your local government/governing body. So if you live in Australia, you will always pay your income tax to the Australian government. It doesn’t matter if your customers are based in the USA: you do not pay income tax to the USA government, you would pay it to the Australian government. ***Do I Need to Collect and Pay Sales Tax?*** In the USA, it is states that you need to collect and pay sales tax to - not the federal USA government. Previous to June 2018, there was a law in the USA that meant that you had to have nexus in a state before you were required to collect and pay sales tax in it. Nexus is a legal term that means you have a sufficiently large physical presence in a state to be eligible to collect and pay sales tax. For example, if you lived in Arizona then that would be a very large physical presence, and so you would have nexus in it. If a customer comes to your dropshipping store and purchases a mug from you, you would be required to collect and pay sales tax on that order. The sales tax rate in Arizona in 5.6%. You could need to collect this tax on the order and pay it to the Arizona state. Now let’s imagine that a customer from Texas came to your store. Because you didn’t live there (or have any physical presence in Texas), this means that you didn’t have nexus in Texas. That meant that you were not required to collect sales tax on that order and pay it to the Texas state. This also meant that if you were not a USA citizen that you usually did not have nexus in any state, and thus didn’t have to collect/pay any sales tax at all. However, in June 2018 a Supreme Court ruling (South Dakota vs. Wayfar) changed this. It abolished this law and said that states can now require large out-of-state vendors to have to collect and pay sales tax. So… does this mean that you now have to collect and pay it even if you don’t have nexus? NO! It doesn’t. To be required to collect and pay it, the following needs to happen: 1) A state needs to pass a law which overrides the baseline nexus law (most states have not passed a bill yet). 2) You will need to be a large vendor (the current baseline is doing $100,000+ sales in a single state, or 200+ transactions in a year). For most established stores, this means that they will likely only have to start collecting and paying sales tax in a small percentage of states - likely the large ones such as New York City. BUT, if you are a new dropshipper then you do not need to worry about this until you start making a lot of money and making a lot of sales. For now, you only need to collect and pay sales tax on orders made in states that you have nexus in (which for most people, will only apply to the state that they live in). I always recommend that any new entrepreneur gets their own accountant. * This video only covers your tax obligations when dropshipping to customers based in the USA, as that is what we teach on this channel (how to start a store and then target USA-based customers). QUESTION 1: What Taxes Do I Need to Pay When Dropshipping? When you are dropshipping, there are two types of taxes that you may need to pay: ***Income Tax Obligations*** Everyone is required to pay income tax (unless you live in an income tax haven). You only need to pay income tax on the profit that you made from your store, not the total revenue. You pay income tax to the country that you live in. So that means that if you live in Canada, you pay income tax to the Canadian government. The same goes for Australia - if you live in Australia, you pay income tax to the Australian government. You do not live in the USA, then you do not pay income tax to it, even though you are selling to USA citizens. If you do live in the USA then you will be required to obey both the federal and state laws regarding income tax. ***Sales Tax Obligations*** While everyone is required to pay income tax to their local country of residence, not everyone watching this video will be required to pay sales tax. In the USA, you are only required to collect and pay sales tax to a state if you have “nexus” in it. Nexus is a legal term which means that you have a sufficient physical presence in a state that you now need to collect and pay sales tax within it. In the USA, the federal government does not require you to collect and pay sales tax. It is handled by each individual state. So to be required to collect and pay sales tax within one, you need to have a sufficient physical presence in that state (nexus). This means that if you live outside of the USA in another country (such as Australia, UK, India, Canada etc) then it is very unlikely that you have nexus in any USA state. That means you are not obligated/required to collect and pay sales tax on any orders made by USA customers. If you live in the USA, then you most likely only have nexus in a single state - the state that you live in. However, if you suspect you have a physical presence in another state, for example: * You rent/own property in another state. * You have a remote employee in another state. Then I would strongly recommend going to an accountant and talk to them to find out which states you do have nexus in. Question 2: How Do I Collect & Pay Sales Tax when Dropshipping? Once you know which states you have nexus in, you now need to collect sales tax on orders made by customers with shipping addresses within it. If you are using Shopify, setting your store up to collect taxes is very simple, and we have included step-by-step instructions within this video. Something important to note is that Shopify will automatically calculate taxes for destination based states, which is very helpful. A destination based state (such as New York) requires you to collect and pay sales tax based upon where the customer you’re dropshipping to lives, not where you live (in comparison to origin based states). This can get pretty complicated since each city/district has its own taxes! For example, in New York City, the sales tax rate is 8.875%. But in the city of Buffalo, the sales tax rate is 8.75%. You need to collect and pay the right sales tax for each order. What Shopify does is it will automatically calculate the correct tax based upon where the customer is - making this super simple. I also recommend using TaxJar (which automatically syncs with Shopify) as it will generate an automated report which will make paying sales tax much easier, plus they also have an auto-file option for most states which makes filing your taxes even simpler. They were raised in the same home, with the same parents, had the same IQ, same skills and same opportunities. Each was married and had two children. They were all carpenters making $25 per hour. While they were very similar in all these respects, they had different priorities. For example, Tom, chose to work 20 hours per week, while his brother, Dick worked 40 hours and Harry 60. It should also be noted that Harry's wife worked full time as an office manager for a salary of $50,000. Dick's wife sold real estate part time 10 hours a week and made $25,000 per year. Tom's wife did not work. Tom and Dick spent all of their family income. Since they paid into Social Security they figured, they didn't need to save for retirement. Harry and his wife, on the other hand, had, over many years, put away money each month and invested it in stocks and bonds. Here's how it worked out: Tom made $25,000 a year, Dick and his wife made $75,000 and Harry and his wife, $150,000. When a new housing development opened up in their community, the brothers decided to buy equally-priced homes on the same private street. One day the brothers decided to pool their funds for the purpose of improving their street. Concerned about crime and safety, and wanting a more attractive setting for their homes, the three families decided to install a security gate at the street's entrance; repave the street's surface; and enhance the lighting and landscaping. The work was done for a total cost of $30,000. Harry assumed they would divide the bill three ways, each brother paying $10,000. But Tom and Dick objected. "Why should we pay the same as you?" they said. "You make much more money than we do." Harry was puzzled. "What does that have to do with anything?" he asked. "My family makes more money because my wife and I work long hours, and because we have saved some of the money we've earned to make additional money from investments. Why should we be penalized for that?" "Harry, you can work and save all you like" Tom countered. "But my wife and I want to enjoy ourselves now, not 25 years from now." "Fine, Tom. Do what you want. Luckily, it’s a lot easier than collecting and paying sales taxes on items you’re dropshipping (haha!) but you still need to collect them. Question #1 about Amazon FBA & Sales Tax: When do you have to pay sales tax to a state? When it comes not just to Amazon FBA & sales tax, but any sales tax obligations in the USA, you pay them to the individual states and not the federal government. It’s important then to know which states you owe sales tax too. To answer this, you need to answer a different question: Do you have sales tax “nexus” in a state? Having “nexus” means that you have a sufficient legal presence in a state that you are required to collect and pay sales tax within it. The exception to this are the following states which don’t have sales tax: * Delaware * Montana * Oregon * New Hampshire When it comes to Amazon FBA & sales tax then, if you only have nexus in any of those states, you don’t need to collect/pay sales tax. Alaska has no statewide tax, but it allows districts to charge local sales tax, so you will usually have to pay sales tax on sales made within Alaska regardless. Question #2 about Amazon FBA & Sales Tax: How do I know if I have nexus in a state? You have nexus in whatever state you live in. If you live in New York City, then you have nexus in the state of New York. If you don’t live in the USA then this doesn’t apply to you. If you have a physical building in a state, you’ll also have nexus there. Different states have their own individual rules. For example, in some states, having a remote employer there would give you nexus in their state. As an Amazon FBA seller, you will inevitably have nexus in whatever state your Amazon FBA inventory is stored in. Amazon FBA program has warehouses in 22 states. These states are the exception: * Delaware & New Hampshire as they don’t have sales tax. * Virginia as their department of taxation has ruled that having inventory in a warehouse does not constitute having nexus in their state. Question #3 for Amazon FBA & Sales Tax: How much sales tax do I pay? The answer to this depends on whether you have nexus in an origin state or a destination state. In an origin state you pay the sales tax rate of where your physical location is based from. If you have nexus in a destination state, then it gets more complicated as different districts, cities and counties have their own sales tax rates. For example, New York is a destination based state. If you had a customer based in New York City, you’d collect and pay 8.875% on their order. This includes: * 4% State tax * 4.5% Local tax * 0.375% Special Metropolitan Commuter Transportation District surcharge. Whereas if you had a customer in Buffalo you’d collect and pay 8.75% sales tax: * 4% State tax * 4.75% Local tax They are both based in the state of New York, but each order requires you collect and pay different taxes. Question #4 about Amazon FBA & Sales Tax: How do I collect and pay sales taxes with Amazon? 1. Figure out which states you have nexus in. 2. Register to pay sales tax in each of those states which you can do online. 3. Upgrade to Pro Amazon account if you haven’t already. 4. Login to your seller account and click “Tax Settings.” 5. Click “Tax Settings” and then “View/Edit your Tax Collection and Shipping & Handling.” 6. Choose your Product Tax Codes (you can select “Use Default Product Tax Code” to make this easy). 7. Specify your tax obligations. Tick the boxes relevant to the states you have nexus in. TaxJar (http://wholesaleted.com/go/taxjar) Amazon will charge you 2.9% on the tax they collect, but it’s well worth it! Question #5 for Amazon FBA & Sales Tax: How do I pay sales tax to each individual state? You do this online on each state’s website. Unfortunately this can be a tiring process if you have nexus in a destination state as you need to specify how much tax is supposed to go to each district/city etc. Luckily, TaxJar makes this process super simple. Simply sign up for an account with them, and connect it to your Amazon account. They will create a report for you which outlines how much tax you owe to each state and how it should be distributed. They also have a fantastic autofile feature which will automatically file your taxes in over 30 states, making the process even more simple. TurboTax for 2018 Tax Returns - Easy!

Turbotax is the software I use to file my family's taxes. I've been using Turbotax going on nearly 25 years with a 3 yr break when we lived in NJ. Because I worked in Philly I had to file the Philly Wage Tax return PLUS the NJ tax return and the Feds and TurboTax didn't seem to have that up to snuff. So, I just hired a CPA from my church who I liked quite a bit. But now we're back in the South, taxes are easy enough to use Turbotax. And I like TurboTax indeed. Now, my wife worked for HR Block last year and I like those guys too. First off, if you’re just starting out with Amazon or Ebay drop shipping you do not need to worry about this at all.. I ran my business as a sole proprietor for a long time and made job replacing income without any issues. Learn more about sales tax here: http://www.avalara.com/learn/ The U.S. is one of the very few countries in the world that applies a final sales tax as it's primary transactional tax system. Most OECD countries use a VAT or GST system. If you're not used to doing business in the the U.S., this can make understanding sales tax a bit difficult. So today I'm going to explain what sales tax is and focus on three key areas of compliance. How does sales tax work in the U.S? Well sales tax is a consumption tax on the final sale of a good or a service. Let's take the example of a retailer in U.S. that sells to a consumer. They are selling work boots here. The retailer would charge sales tax on the sale of the work boots as a percentage of the sales price, collect that tax from the consumer and remit it to the right government agencies at the right times. Seems pretty simple. However, there a few factors which make sales tax compliance in the U.S quite complex. Number one, there are over 12,000 taxing jurisdictions in North America and each can have their own rules and rates when it comes to sales tax. So the retailer needs to keep track of the right Sales Tax rate for these work boots across all the jurisdictions where they do business. Rules can also vary regarding product taxability. So those work boots might be taxed at different rates in different states relative to other types of clothing. In some states, they may be exempt. And there're also certain times of the year when they might be exempt in certain states. For example in Texas, there is a sales tax holiday, often in August where work boots are exempt from tax, but for the rest of the year, you need to charge sales tax on work boots in Texas. This makes for a very complex set of rules when you are trying to stay compliant in the U.S. Let's jump further up in the supply chain. Unlike VAT or GST, where tax is remitted to the government each time value is added, sales tax is only collected and remitted on the final sale. Let's say you had a manufacturer who made the work boots and sold it to the retailer. Even though they might not collect tax from the retailer, because the retailer is a re-seller, they are still on the hook for some paperwork. They need to collect documentation that proves this is a tax exempt sale and there are some other reasons you might make tax exempt sales in the U.S. For example some entities enjoy tax exempt status such as non-profits. Then there is the question of where a business is obligated to collect and remit sales tax in the U.S. The question of nexus, nexus being the connection between the business and the taxing jurisdiction that triggers the tax obligation. These, again, vary from jurisdiction to jurisdiction. So in most jurisdictions, if you have physical presence there, like a warehouse or office buildings, you likely have to collect and remit sales tax there. However, there're are other laws. For example, if you have remote workers in some tax jurisdictions, you might have nexus there. If you send people to trade shows in some jurisdictions, you might have nexus there. If you work with affiliates in some jurisdictions, they can give you nexus. To the extent that in some jurisdictions, if an affiliate puts a link on their website that sends customers to your website, you could be liable for collecting sales tax in that jurisdiction. As you can see, a simple tax concept can get quite complex in the U.S. We have a lot of resources on our side including white papers and videos if you'd like to learn more about any aspects of this tax system. Question: What taxes do I need to pay? 1) Income tax to your local governing body (if you live in Australia, you’d pay it to the Australian government, if you live in the USA you’d pay it within the USA etc). 2) Sales tax. In the USA, sales tax is collected by individual states, and NOT the federal government. You will usually pay a state tax + a local district tax + in some cases, a special tax. In addition, some states are origin based (you pay the sales tax rate based on where the item is being shipped from) and some are destination based (you pay the rate based on where the customer is based). Destination based in tricker because the rate you collect/pay is always changing. Question: Who has to pay sales tax when dropshipping - me, the dropshipper, or both? First, determine whether you or your dropshipper has nexus in a state. Nexus is a legal term which means that your business has a sufficient physical presence in a state that means you need to collect and pay sales tax within it. Based on this, you’ll fit into one of 5 scenarios: 1) Your customer is based in Oregon, Delaware, New Hampshire or Montana Congratulations! These states don’t have sales tax so neither you nor your dropshipper have any obligations to collect/pay sales tax for these customers. 2) Neither you nor your dropshipper have nexus in your customer’s state Neither you nor your dropshipper need to collect/pay sales tax on these orders. 3) Your dropshipper has nexus in your customer’s state, but you don’t. Some states will require that they collect sales tax. But, if you provide them with a resale certificate/license, this sales tax can usually be waived. 4) You have nexus in your customer’s state, but your dropshipper does not. You need to collect/pay sales tax on the orders, not your dropshipper. 5) Both you and your dropshipper have nexus in your customer’s state You’ll need to provide your dropshipper with a resale certificate/license. It means they can waive the sales tax on the order between the two of you, and then you’ll be required to collect it from the customer. Question: How do I get sales tax waived? If you’re eligible to have sales tax waived you’ll need to get a resale certificate/license to prove that you’re buying the items for the purposes of resale. I recommend that you use a service called TaxJar. Get a free 30-day trial here: http://wholesaleted.com/go/taxjar For Woocommerce, they have a free plugin which when connected sets up your sales tax settings for you. For Amazon.com it connects to your account to easily create reports that makes submitting your returns easy. In addition, if you’re selling on Amazon I recommend setting up their Amazon Tax Service. Here is how you do it: Step 1: Login to your seller account. Step 2: Click on settings and click “Tax Settings.” Step 3: Click “View/Edit your Tax Collection and Shipping & Handling.” Step 4: Choose how to manage your Product Tax Codes. To make it easy, you can select “Use Default Product Tax Code.” Step 5: Specify your Tax Collection Obligations. TaxJar have a free cheat sheet you can download which tells you which boxes to tick. TaxJar also connects to your Shopify account to make reporting easy. And be sure to set up your sales tax settings under the “Tax” option. Under physical presence, type in the state you have nexus in. If you have a physical address tied to your nexus, type in the ZIP for it too, and save that entry. Do this for each state. Shopify will now automatically add sales tax to each purchase in the states you have nexus in. Question: How do I pay the sales tax? You will need to file a report with each state and outline how much money goes to each district, city etc. Because of all of the different district/special taxes this is a lot of paperwork. That is why I recommend you use TaxJar’s autofile feature, which will file and pay your sales tax returns for you in 37 states. You can find the time stamps below: Q: Overall, how does the tax reform affect small businesses? [1:05] A: You can expect to save money on your taxes, which means it's a great time to invest in the business, whether that's hiring more employees, buying more equipment, or expanding. Q: 95% of small businesses are pass-through entities, and they experience big tax cuts. First, what is a pass-through entity? [3:33] A: A pass-through entity is either sole-proprietorships or LLCs. It's a business structure in which the income from the business passes through to an individual's tax return. Q: What tax cuts do pass-through entities get? [4:32] A: You get a 20% deduction for the net profit of the business. Q: Does that deduction apply to every pass-through entity? Are there limitations? [5:14] A: There are limits: Not everyone can get the 20% deduction. Compensation is an example: If your taxable income is over $157,000, then that tax deduction will be phased out. Some industries also have limitations, like consulting services or law practice. Q: Should small businesses switch to a C corp to capitalize on the massive tax cut for C corps? [8:00] A: No, not necessarily. The pass-through entities also enjoy great tax benefits. Also, C corps are often called "double taxation entity" for a reason. Your entity is set up not only for tax purposes but for legal purposes. Also, if you change to a C corp, it's a one-way street: it's hard to change it back. So, definitely consult a tax advisor for your specific situation. Q: Any changes to the meals and entertainment deductions? I heard they are going away. [10:23] A: Yes! Meals and entertainment are being reduced from 100% deductible to 50% deductible. Q: How about other important deductions, like commuter benefits? [12:43] A: Commuter benefits are now not tax deductible at all for employers. Pro Tip! As a workaround, it might be worth trying to negotiate with your landlord if you can incorporate parking into your rent, which is tax deductible. Q: Do these tax changes affect our 2017 tax returns, or does it just apply to 2018? [15:50] A: Nope, it only pertains to 2018 moving forward. Q: What is Section 179, and what are the changes to it? [17:45] A: Section 179 allows you to expense equipment purchased for the business. With the new tax reform, it has been broadened and you can deduct even more -- from $500,000 to $1,000,000. Q: How can I deduct unreimbursed business expenses without itemizing? [19:21] A: It depends on the kind of pass-through entity you have. Will goes into more of that here. Q: Any changes to business expenses that we should know about? [20:35] Kenji: There are going to be some reductions to the interest expense. This will impact real estate the most. Listen to learn more on that! Will: There are changes to the standard deductions and the personal exemption on your personal tax return. In fact, that entirely goes away with the new reform. There are some pros and cons with that change. Q: What should people expect from their CPA? [23:55] A: They should be proactive and reaching out to you to provide more guidance amidst the changes. Get our free ebook: http://wholesaleted.com/4-step Freightos: http://wholesaleted.com/go/freightos First mistake importers make when importing products from China: Assuming that shipping by sea will be the cheapest option A lot of new importers think they will save money if they ship by sea rather than air. On the surface it seems cheaper as importers usually pay around 60 cents/KG when shipping via sea, compared to the $7/KG when shipping by air courier. Unfortunately what they don’t realize is that the reason it’s that cheap is because when shipping via sea, you ship via container, and you need to rent an entire container. They are very large and require you to be shipping hundreds of KGs to be making it worth your time. If you are an Amazon private label seller, you are unlikely to have enough stock being shipped to fill a container by at least 60-70% so it will be cheaper to ship by air. When shipping by air, you have two options: 1) Air freight 2) Air courier Air courier is when you have your items shipped door-to-door. It is the easiest but the most expensive per KG (although in smaller quantities it is cheaper). Air freight is when you have your items flown from one airport to the other. You will need to organize other additional services: * Having the items delivered to the airport * A customs broker * Having the items delivered from the airport to the final location. There are a lot of fixed fees with this which means it becomes cheaper to use air freight with larger quantities. To figure out which option will be cheaper for you, I recommend using Freightos. Second mistake importers make when importing products from China: Not using the Metric system In China, they use the Metric system and not the Imperial system. So be sure to use KGs instead of lbs and CM instead of inches. It’s important to remember that when working with Chinese suppliers that they expect you to work on their terms and their timeframes. It can be frustrating, but it’s worth it for the cheap Chinese products you import! Third mistake importers make when importing products from China: Using Less than Container Load for shipping When shipping by sea, you have two options: 1) FCL which stands for Full Container Load 2) LCL which stands for Less than Container Load Inexperienced importers fall for the trap of shipping with LCL because they see that the price are extremely cheap. What they don’t realize is that these LCL companies have special deals with the ports to charge you extremely high Destination Service Charges. The LCL companies then make their money in the form of a “rebate” which is essentially commissions/kickbacks. Destination Service Charges are usually priced per-container and cost between $500-$1000 per container for ports in the USA. But when shipping by LCL you end up paying a high fee per cubic meters. It means that you often end up paying a fee comparable to shipping an entire container. Don’t fall for this trap: If you can’t break even with FCL, then ship by air. Fourth mistake importers make when importing products from China: not calculating the correct duties you will need to pay When you import products from China, you will need to pay duties at the border. If you don’t calculate the correct rate you can get a shock if it comes back as more than you expected. Duties can be a bit complicated to work out because there are a lot of variables. For example, if you imported woolen jackets, you need to consider which country the wool came from, as some countries (like Israel) have duty-free agreements over wool, which would reduce the duties you had to pay. On the other hand if synthetic fibres were used instead of pure wool, then your duty rates would be higher since there are higher duties applied to synthetic fibres within the USA. To figure out what your duty rate is, find out what the HTS (Harmonized Tax System) code is for your item. To find this, ask your Chinese supplier as they will most likely know. You can then go through the HTS manual and find what the duty rate is for the HTS code of your products. Fifth mistake importers make when importing products from China: being afraid to make mistakes And finally - don’t be afraid to make mistakes. Through making mistakes you learn how to overcome them the next time and make even more money. Mistakes are apart of entrepreneurship. Learn from others - and learn from your own as well!

Apple has almost always had a reputation of pricing their products quite a bit higher than their competition, and this premium cost is commonly referred to as the Apple Tax. And it can be traced as far back as the original iPod in 2001, which had a starting price of $399, or about $570 adjusted for inflation. And when compared to other hard drive-based music players that sold for around $200, the iPod’s price was staggering. And when the iPhone was released in 2007, one of its biggest criticisms was its price, coming in at $499, or about $600 today, and that was with a two-year contract. And don’t forget the MacBook Air, which debuted with a $1,800 price tag. And that got you just 64GB of solid state storage. So the Apple tax is nothing new to longtime Apple users, but there has been an unusual trend upward in almost all Apple’s product categories over the past few years. And I think there’s more to that story than the Apple tax can account for.
