Control Taken Back? Brexit, the people and parliament (Sakharov Debate 2018 Full Event)

01:30:07
Sakharov Debate 2018, Full Event 30.11.2018 Event co-organised by the European Parliament Office in the UK and the UCL European Institute Speakers James Carver MEP - Independent Member of the European Parliament for the West Midlands Matthew Goodwin - Professor of Politics and International Relations, University of Kent Ronan McCrea - Professor of Constitutional and European Law, UCL Laws Gina Miller - Businesswoman and political campaigner Martine Croxall (moderator) - BBC News Presenter Description The demand to “take back control” played a central role in the Leave campaign. The UK was to regain power not only over its borders, but also over its way of life and its laws. UK citizens would be re-empowered through their democratically elected national, for some regional, and local representatives, whom they could hold to account at the ballot box. Parliament was to become sovereign again, able to change legislation it deemed no longer appropriate. Laws and rules applicable in the country would be made here once again, freeing the country from the shackles of the European Court of Justice and the supremacy of EU over UK law. As such, Brexit promised to enhance both citizens’ political rights and parliamentary sovereignty. The former, which are the original and main part of international human rights, encompass rights of participation, including the rights to vote and to petition, as well as to seek legal remedy or redress and to procedural fairness. The latter, as a principle of the UK constitution, makes Parliament the supreme legal authority in the UK, which can create or end any law. Generally, the courts cannot overrule its legislation and no Parliament can pass laws that its successors cannot change. Four months before the UK is scheduled to leave the EU, this panel debate will take stock of both. How have our political rights and parliamentary sovereignty fared in the process of negotiating and legislating for Brexit? How has this process affected the balance between the government/ civil servants and the legislature? How far was Parliament able to check, influence, and hold the executive accountable? How did checks and balances between government, Parliament and the Courts play out in the negotiations, and in transposing the whole body of EU law onto the UK statute book? What is the situation likely to be as a result of Brexit? Will Parliament stand empowered? Will we as citizens be able to exercise our political rights more meaningfully? How much of our law will be made domestically, and how far will UK laws, standards and regulations, still have to mirror EU ones? Will this change down the line and, if so, when and how? What will it mean for UK citizens to lose their EU citizenship and the political rights that come with it? What will Brexit do to the political rights of particular groups, including British expats settled in the EU and EU citizens living in the UK?

Law or Uniform Commercial Code and commonly refereed to as Maritime admiralty Law. It traces back to when the Caesars of Rome colonized the world and started using the natural laws of the cycles of life against and to commercially enslave humanity.

Dani Rodrik and Tyler Cowen on Economics Rules

49:41
After the financial crisis the credibility of the economics profession took a major hit in the public eye. However, it is worthwhile to ask “what failed?” Is the theoretical underpinning of the profession structurally flawed or have some practitioners simply gone astray from the fundamental principles of economic analysis? Understanding what are the intellectual blind spots of economics and how they should be internalized is a key component of a fundamental shift in thinking that is required in the profession in order to responsibly move forward. The future of economics might be better served by avoiding the question of “which is the right model?” alternatively focusing on identifying “which model is appropriate for the specific task at hand.” Dani Rodrik, Ford Foundation Professor of International Political Economy at the Harvard Kennedy School Moderated by Tyler Cowen, Holbert L. Harris Professor of Economics at George Mason University and General Director of the Mercatus Center

Are Human Rights Really Relevant to Tax?

01:32:31
Human Rights and Tax in an Unequal World September 22, 2016 NYU Law's Center for Human Rights and Global Justice Panel 1: Are Human Rights Really Relevant to Tax? Introduction: Nikki Reisch, Legal Director, Center for Human Rights and Global Justice Panelists: Allison Christians, McGill University Faculty of Law Reuven Avi-Yonah, University of Michigan Law School Edward Kleinbard, USC Gould School of Law Mitchell Kane, NYU School of Law This panel featured leading tax scholars and practitioners discussing what relevance human rights law has or could have to the field of tax law. Do human rights matter to tax policy and practice? Are human rights laws and institutions relevant to understanding and regulating the global tax system? How do the core principles of the human rights regime — non-discrimination, equality, and dignity — inform thinking on the power to tax, the design of tax policies, and the implementation and enforcement of tax laws? Can human rights law help trace the line between permissible tax competition and impermissible interference with other States’ tax sovereignty? Panelists will discuss how tax experts are, or whether they should be, grappling with concepts of human rights and corresponding duties as they chart reforms of domestic and global tax policies, and what they need from the human rights community to do so.

Thomas Russo: "Global Value Investing: Factors that I Most Fear and [...]" | Talks at Google

01:11:33
Thomas Russo describes the important ingredients of his tax-efficient, long-term buy-and-hold approach to “global value” equity investments. He touches upon the two aspects most important to his investments: 1. Reduction of Agency Costs 2. The “Capacity to Reinvest” Mr. Russo’s presentation, in addition, focuses on factors which form a sort of checklist which Mr. Russo observes when attempting to reduce risks in his search for global returns. Mr. Russo addresses a handful of investments which failed to deliver expected returns, believing that as Mr. Buffett is prone to say that ‘good decisions come from good judgment, and good judgment comes from bad decisions'. Finally, Mr. Russo shares some personal reflections from his professional lifetime of “global value” equity investments. Such references cluster around the “Big Cs”: 1. Compound Interest 2. Character 3. Culture 4. Capacity to do Nothing About the speaker: Thomas Russo was born in 1955 and grew up in Titusville, Pennsylvania, a small town best known as the birthplace of the oil industry. He graduated from Dartmouth College with a degree in history in 1977 and from Stanford University with degrees in law and business in 1984. He then joined Ruane, Cuniff & Goldfarb, where he worked on the firm’s flagship Sequoia Fund. In 1989, he joined Gardner Investments (now Gardner Russo and Gardner), a Pennsylvania-based firm catering mostly to high-net-worth individuals, where he manages the Semper Vic investment partnership.

Feet to the Fire Radio: Jim Jatras on FATCA

30:16
FATCA. it has been called, "The Worst Law Nobody Has Ever Heard Of." The Foreign Account Tax Compliance Act (FATCA), which was passed as part of the HIRE Act, generally requires that foreign financial Institutions and certain other non-financial foreign entities report on the foreign assets held by their U.S. account holders or be subject to withholding on withholdable payments. The HIRE Act also contained legislation requiring U.S. persons to report, depending on the value, their foreign financial accounts and foreign assets. -IRS.GOV Foreign Affairs expert, Jim Jatras joins us to talk about the many problems with this law that sets a bad example of forcing countries to obey our internal laws with threats of sanctions; a two way street. It was used by the Obama Admin to "fund" other programs they passed, but, to date has greatly under performed expectations and will soon cost more to enforce, then it collects. James George Jatras is a specialist in international relations, government affairs, and legislative politics. Prior to joining Squire Sanders in 2007, he was a partner with another Washington DCbased law firm. Before entering the private sector he served for many years (1985-2002) as a policy adviser and analyst for the Republican leadership in the U.S. Senate; before that (1979- 1985), he was a U.S. Foreign Service Officer with the US Department of State, with service in Mexico and in Soviet affairs and public diplomacy. http://repealfatca.com http://www.internationalman.com/articles/fatca-the-worst-law-nobody-has-ever-heard-of-part-i http://www.newsmax.com/Finance/Personal-Finance/Rand-Paul-Mark-Meadows-Trump-FATCA/2017/04/06/id/782935/ http://www.zerohedge.com/news/2017-01-31/fatca-needs-go-unfortunately-fatca-refugees-are-never-coming-back https://www.thenewamerican.com/economy/economics/item/25352-with-trump-and-gop-in-power-new-push-to-stop-fatca-horror-show http://www.wolterskluwerfs.com/onesumx/white-paper/from-FATCA-to-GATCA.aspx Writings from Jim: http://innersites.com/feet2fire/archives2017/media/MoreJimJatras.pdf Website: http://JimJatras.com Twitter: @JimJatas

Tobias Carlisle: "Deep Value Investing" | Talks at Google

01:00:47
"Deep Value: Why Activist Investors and Other Contrarians Battle for Control of Losing Corporations" is an exploration of the philosophy of deep value investment. It describes the evolution of the various theories of intrinsic value and activist investment from Benjamin Graham to Warren Buffett to Carl Icahn and beyond. Filled with engaging anecdotes, penetrating statistical analysis and meticulous research, the book illustrates the principles and strategies of deep value investing and examines the counterintuitive idea behind its extraordinary performance. About the Book It is a simple, but counterintuitive idea: Under the right conditions, losing stocks—those in crisis, with apparently failing businesses, and uncertain futures—offer unusually favorable investment prospects. This is a philosophy that runs counter to the received wisdom of the market. Many investors believe that a good business and a good investment are the same thing. Many value investors, inspired by Warren Buffett’s example, believe that a good, undervalued business is the best investment. The research offers a contradictory view. Deep Value is an investigation of the evidence, and the conditions under which those losing stocks become asymmetric opportunities, with limited downside, and enormous upside. In pursuit of this idea, it canvases the academic and industry research into theories of intrinsic value, management’s influence on that value, and the impact of attempts to unseat management on both market price and value. The value investment philosophy as first described by Benjamin Graham identified targets by their discount to liquidation value. That approach has proven extremely effective; however, those opportunities have all but disappeared from the modern stock market. To succeed, today’s deep value investors have adapted Graham’s philosophy, embracing its spirit while pushing beyond its confines. In Deep Value, I examine Graham’s 80-year-old intellectual legacy using modern statistical techniques to offer a penetrating and highly original perspective: That losing stocks offer unusually favorable investment prospects. The evidence reveals an axiomatic truth about investing: Investors aren’t rewarded for picking winners; they’re rewarded for uncovering mis-pricing.

IBEW: Health Reform: Real People, Real Problems

Members of the International Brotherhood of Electrical Workers joined with hundreds of other union members and health care activists calling on Congress to make quality and affordable medical coverage available to every American on June 25. The message of the rally was loud and clear. Our nations health care system needs to be fixed and fast. Rally participants called on legislators to pass real health care reform. This means including a public health insurance option which can give working families a choice when it comes to their insurance needs and no taxes on existing health benefits.

Academy Awards Alert! Why You Might Be a Fashion Criminal

06:31
Say you don't have the dough to add the fashions you see at Sunday's Academy Awards ceremony to your closet. If you buy knockoffs instead, are you shopping smart or stealing?

Today it's perfectly legal to copy whatever you see on the red carpet and sell it yourself. To some, such as Diane Von Furstenberg, this sounds a lot like theft. The former German princess is one of the world's most successful fashion designers and she's teaming up with Senator Chuck Schumer (D-NY) to push a bill that would give designers a three-year monopoly on new creations.

The whole point of intellectual property is to spur innovation, and that, according to supporters, is exactly why the fashion industry needs such a bill. Without tougher protections, they say designers will have less incentive to create new looks.

But is the fashion industry really hurting for innovation? And are top-tier designers like Von Furstenberg really getting ripped off by bargain hunters? And even if they were, who's to say whose look is truly original?
Johanna Blakely of USC's Norman Lear Center worries that the relentless push for more intellectual property protection could lead to a situation where big design houses lawyer up and sue young designers. Designer Galina Sobolov, head designer and owner of Single by Galina Sobolov, agrees.

"If this bill was in effect as we grew our company, we would have faced probably millions of lawsuits," says Sobolov, whose designs have been worn by celebs such as Katy Perry and Rachel Hunter. "And we would have never actually had a company."

Approximately 6.30 minutes.

Medved evades,contradicts himself and suffers.

Michael Medved is intent on evading facts that do not fit his militaristic - interventionist public policy. He also will not admit that deterrence works with countries and in particular that the Iranian leadership is not suicidal. Furthermore, when he offers a principle we should use to determine when to go to war, he contradicts himself and agrees we should not follow his own principle. All this evasion and contradiction does not come without a price. You can see his suffering in his pained look. Enjoy. Part 4

Margrethe Vestager, EU Commissioner for Competition: policy from a Euro perspective | LIVE STREAM

55:57
There is broad global agreement on basic principles of competition policy: Firms with market power should not engage in conduct that mainly harms competition; mergers should not lead to monopoly; government subsidies should not favor some competitors over others. But important debates remain. How much weight should be given to keeping prices low versus creating incentives for investment and innovation? Should antitrust seek to protect competitors or competition? On September 18, European Commissioner for Competition Margrethe Vestager will visit AEI to discuss the EU perspective on these and other important issues in competition policy. A Q&A session with Commissioner Vestager will follow. THE LIEBER CODE AND GENERAL ORDERS 100 APRIL 24 1863

15:30
DMartial Law - Military jurisdiction - Military necessity - Retaliation Article 1. A place, district, or country occupied by an enemy stands, in consequence of the occupation, under the Martial Law of the invading or occupying army, whether any proclamation declaring Martial Law, or any public warning to the inhabitants, has been issued or not. Martial Law is the immediate and direct effect and consequence of occupation or conquest. The presence of a hostile army proclaims its Martial Law. Art. 2. Martial Law does not cease during the hostile occupation, except by special proclamation, ordered by the commander in chief; or by special mention in the treaty of peace concluding the war, when the occupation of a place or territory continues beyond the conclusion of peace as one of the conditions of the same. Art. 3. Martial Law in a hostile country consists in the suspension, by the occupying military authority, of the criminal and civil law, and of the domestic administration and government in the occupied place or territory, and in the substitution of military rule and force for the same, as well as in the dictation of general laws, as far as military necessity requires this suspension, substitution, or dictation. The commander of the forces may proclaim that the administration of all civil and penal law shall continue either wholly or in part, as in times of peace, unless otherwise ordered by the military authority. Art. 4. Martial Law is simply military authority exercised in accordance with the laws and usages of war. Military oppression is not Martial Law: it is the abuse of the power which that law confers. As Martial Law is executed by military force, it is incumbent upon those who administer it to be strictly guided by the principles of justice, honor, and humanity - virtues adorning a soldier even more than other men, for the very reason that he possesses the power of his arms against the unarmed. Art. 5. Martial Law should be less stringent in places and countries fully occupied and fairly conquered. Much greater severity may be exercised in places or regions where actual hostilities exist, or are expected and must be prepared for. Its most complete sway is allowed - even in the commander's own country - when face to face with the enemy, because of the absolute necessities of the case, and of the paramount duty to defend the country against invasion. To save the country is paramount to all other considerations. Art. 6. All civil and penal law shall continue to take its usual course in the enemy's places and territories under Martial Law, unless interrupted or stopped by order of the occupying military power; but all the functions of the hostile government - legislative executive, or administrative - whether of a general, provincial, or local character, cease under Martial Law, or continue only with the sanction, or, if deemed necessary, the participation of the occupier or invader. Art. 7. Martial Law extends to property, and to persons, whether they are subjects of the enemy or aliens to that government. Art. 8. Consuls, among American and European nations, are not diplomatic agents. Nevertheless, their offices and persons will be subjected to Martial Law in cases of urgent necessity only: their property and business are not exempted. Any delinquency they commit against the established military rule may be punished as in the case of any other inhabitant, and such punishment furnishes no reasonable ground for international complaint. Art. 9. The functions of Ambassadors, Ministers, or other diplomatic agents accredited by neutral powers to the hostile government, cease, so far as regards the displaced government; but the conquering or occupying power usually recognizes them as temporarily accredited to itself. Art. 10. Martial Law affects chiefly the police and collection of public revenue and taxes, whether imposed by the expelled government or by the invader, and refers mainly to the support and efficiency of the army, its safety, and the safety of its operations. Art. 11. The law of war does not only disclaim all cruelty and bad faith concerning engagements concluded with the enemy during the war, but also the breaking of stipulations solemnly contracted by the belligerents in time of peace, and avowedly intended to remain in force in case of war between the contracting powers. It disclaims all extortions and other transactions for individual gain; all acts of private revenge, or connivance at such acts. Offenses to the contrary shall be severely punished, and especially so if committed by officers. Art. 12. Whenever feasible, Martial Law is carried out in cases of individual offenders by Military Courts; but sentences of death shall be executed only with the approval of the chief executive, provided the urgency of the case does not require a speedier execution, and then only with the approval of the chief commander. Art. 13.escription

Thomas Russo: "Global Value Investing" | Talks at Google

01:10:54
“I consider myself to be a farmer—not a hunter. And I think most people on Wall Street are hunters. They like to fell big beasts and I’m very comfortable planting a few rows and just tending to them carefully.” - Thomas Russo About the Talk Mr. Russo looks forward to describing how that in his pursuit of long-term tax-deferred investment returns that he has favored investments in businesses whose global brands are well-position companies for reinvestment of mature market free cash flow into developing and emerging markets. Mr. Russo’s businesses accordingly possess the “capacity to reinvest” and managements who have the “capacity to suffer” when investments properly intended for longest term increase in intrinsic value on a per share basis burden as they often do, reported earnings in the near term. This tradeoff between near-term pain and long-term gain is at the heart of his investments when properly executed, the benefit for taxable investors is the ability to build portfolio companies whose return are long term and tax deferred. About the Speaker Mr. Thomas A. Russo is the Managing Member of Gardner Russo & Gardner LLC, where he oversees $10 billion of “global value” equity investments invested through Semper Vic Partnerships as well as separately managed accounts. Mr. Russo is a Graduate of Dartmouth College (BA, 1977), and a Graduate of Stanford Business and Law Schools (MBA/JD, 1984). Memberships include Dean’s Advisory Council for Stanford Law School, Dartmouth College’s President’s Leadership Council, Heilbrunn Center for Graham & Dodd Investing (Columbia), Facing History and Ourselves, Winston Churchill Foundation of the United States, Storm King Art Center.

11th Anniversary of Department Of Peace

02:44
"Eleven years ago today, I introduced legislation to establish a Cabinet-level Department of Peace and Non-violence. Since July 11, 2001 our nation has experienced the tragedy of September 11th, sent thousands of troops into the Middle East to fight wars, and continued to witness heart-breaking events that the bullying epidemic has caused in our schools such as deadly school shootings and an increasing number of suicides among our nations young people. It is clearer now, more than ever, that we must embrace a Department of Peace as a way to address not only violence in our schools but the violence that exists in our homes, workplaces and institutions throughout our communities both nationally and internationally. "I believe that the government has a responsibility to create an organized approach to address issues of violence in our society. That is why I have continued to introduce the Department of Peace and Nonviolence Act in every Congress since 2001. This legislation seeks to make non-violence an organizing principle in our society. "A cabinet level department would look at root causes and endeavor to find preventive solutions that are both dynamic and comprehensive. H.R. 808 would establish a Secretary position to advise the President on peace-building strategies in times of international conflict. It would establish a Peace Academy to provide instruction in peace education, and offer opportunities for graduates to serve in programs dedicated to domestic or international nonviolent conflict resolution. It would also provide funds to support and expand domestic programs that provide training in known best-practices such as mediation, alternative dispute resolution techniques, and nonviolent communication programs in our public schools and in the public sector workforce. "Today, on the eleventh anniversary of the introduction of the Department of Peace and Non-violence legislation, I ask that we challenge the reflexive war-as-conflict-resolution mindset that our country has adopted. Isn't it time that we end our nation's reliance on weapons and war? Isn't it time that we make a commitment to more peaceful methods of conflict resolution? Isn't it time that we each make our own personal commitment to living a life of nonviolence?"

Speaking Libertarian to Democrats | Harris, Kosinski, Bennett, and Brock

01:01:06
Recorded at #legalizefreedom, the 2016 Libertarian Party Convention, in Orlando, Florida, on May 29, 2016. Recorded and edited by James Holland. Special thanks to all those who purchased tickets to the convention that provided the funds to make this event and video possible. Terry Brock is the MC of the panel discussion. Mr. Brock is a social media marketing speaker. Terry earned an MBA in marketing and is focused on real-world business applications. Terry earned the Certified Speaking Professional designation from the National Speakers Association and was inducted into the Speaker Hall of Fame (a designation awarded to less than 1% of speakers in the world). He delivers live presentations all over the world. Terry wrote the book on Klout, and works with organizations to design social media relationship marketing strategies that are measurable and implementable. He is a syndicated columnist with Business Journals around the US where he writes his weekly column, “Succeeding Today” with over 40 million page views each month. Skype brought Terry on as Chief Enterprise Blogger. He coordinated a host of functions helping this international company to focus on business applications for what was known largely as a consumer-only product. AT&T came to Terry when they needed help with their largest blog, Networking Exchange Blog. He became the Editor-in-Chief for that distinguished publication coordinating a staff of over 100 geniuses in areas of social media, Cloud Computing, Mobility and Security. He was able to help AT&T begin the process that resulted in over $2 billion in sales. Sharon Harris was President of the Advocates from 1995 until 2015. She is the Amazon best-selling author of How to Be a Super Communicator for Liberty, a book which Ron Paul recommends "to everyone serious about winning the battle for liberty." In 2014, she was honored with the National Libertarian Party's Thomas Paine Award for "outstanding communication of libertarian ideas, principles and values." Eva Kosinski holds a degree in Fine Arts, but spent many years at MIT in faculty and tech-support jobs, worked at BBN's pre-Internet university-focused network CSNET, and later ran an artists' services company, helping artists to use technology for their careers. In recent years she has run for public office locally, and was for several years the chair of the Libertarian Party of Boulder County. Ruth E. Bennett ran one of the most successful Libertarian gubernatorial races in Libertarian Party history in 2004 on the issues of marriage equality and decriminalization of marijuana. Both issues have since been adopted by the voters in Washington State. She has been a member of the Libertarian Party since 1978, State Chair in Colorado and Washington State and has run three national conventions (all of which made money!) She is currently the President of the Governing Board in her local school district.
