An Oracle spokeswoman said on Thursday a California jury ordered Oracle Corporation to pay Hewlett-Packard Enterprise Company $3 billion in damages in a case over HP's Itanium servers. Oracle said it would appeal the verdict. The Itaniuum processor is made by Intel Incorporated. According to Reuters, Oracle decided to stop developing software for use with HP's Itanium-based servers in 2011, saying that Intel made it clear that the chip was nearing the end of its life and was shifting its focus to its x86 microprocessor. But HP said it had an agreement with Oracle that support for Itanium would continue, without which the equipment using the chip would become obsolete. In the first phase of trial in 2012, Santa Clara Superior Court Judge James Kleinberg ruled that there had been a contract. Oracle (NASDAQ:ORCL) issued a statement claiming that Hewlett-Packard (NYSE:HPQ) knew all about itanium end-of-life plans before the company found out. The company stated, "We believe that HP specifically asked Oracle to guarantee long-term support for Itanium in the September of 2010 agreement because HP already knew all about Intel's plans to discontinue Itanium, and HP was concerned about what would happen when Oracle found out about that plan. What we know for certain is that Ray Lane and HP's current board members and Leo Apotheker and HP's current management team now know full well that Intel has plans in place to end-of-life of the Itanium microprocessor. Knowing this, HP issued numerous public statements in an attempt to mislead and deceive their customers and shareholders into believing that these plans to end-of-life Itanium do not exist. But they do. Intel's plans to end-of-life Itanium will be revealed in court now that HP has filed this utterly malicious and meritless lawsuit against Oracle." June 16 (Bloomberg) -- Hewlett-Packard Co. sued Oracle Corp. over claims that in a period of eight months Oracle went from partner to "bitter antagonist" and has breached its contract. The lawsuit, filed yesterday in state court in San Jose, California, cites Oracle's hiring of Hewlett-Packard's former Chief Executive Officer Mark Hurd last year and Oracle's March announcement that it would no longer support its database software on Hewlett-Packard computer servers that use the Itanium chip. This morning, Oracle (NASDAQ:ORCL) issued the following statement in regards to the claims that Autonomy CEO Mike Lynch never shopped his company to the tech giant prior to their $11.7 billion dollar acquisition by Hewlett-Packard. "Autonomy had been 'shopped' to Oracle as well, but Oracle wasn't interested because the price was way too high. Mike Lynch, Autonomy CEO, then publicly denied that his company had been shopped to Oracle. Lynch came to Oracle, along with his investment banker, Frank Quattrone, and met with Oracle's head of M&A, Douglas Kehring and Oracle President Mark Hurd at 11 am on April 1, 2011. After listening to Lynch's PowerPoint slide sales pitch to sell Autonomy to Oracle, Kehring and Hurd told Lynch that with a current market value of $6B, Autonomy was already extremely over-priced." Shares of Oracle are trading up 2.5% to $30.20, while Hewlett-Packard are also trading up over 3% to $23.92.
