Adjusting to client requests and established brand packaging
There are situations when a client has established branding or such as a logo or preexisting packaging and it is not feasible to re brand. In such cases, diversity and flexibility is vital and the designer needs to be able to adjust by meshing the client's concept with the designer's own unique vision. In this case study, the established logo of Awakened Heart Productions, by way of what appears to be a rather rudimentary illustration that looks like a first grade art assignment, strategically suggests that they produce content for children. The client's objective to convey their expansion into digital 3D animated content required the melding of their 2D illustrated logo with 3D animation without changing the original form of their logo. There was no need to transform the logo into a 3D model because Awakened Heart Productions (AHP) decided it was important to maintain the illustrated look of the logo in order to reaffirm their continuing commitment to produce children's' content in the traditional formats. Although at first glance the two styles of graphics seem to clash, that is precisely the intended effect.

The company chose a couple of mysterious things for its logo, which looks sort of like an earphone. The designers wanted to show that, with Vodafone, users can talk to each other any time they want. - The Haribo’s founder combined the first 2 letters of his first and last name, Hans Riegel, and added the first 2 letters of his hometown of Bonn. - The arrows on the first and last letters of the Subway logo are there for a reason: they actually stand for the entrance and exit to the subway. This way, the company demonstrates that, with Subway, you can eat on the go, like in the actual subway! - Jim Lee revealed what the new logo of DC Comics actually means. The nooks and angles are meant to evoke the Superman “S” symbol, the Wonder Woman “WW” emblem, and the Bat-Signal. - “Firefox” is the English translation of the Chinese name for a red panda. This way, the company wanted to demonstrate how unique they are because this is a very rare kind of panda that’s actually endangered. - The legend goes that the wife of Bacardi’s co-founder saw a bat in their liquor factory. But instead of getting scared and running for the exit, he took it as a sign and decided that this was exactly what should be on the logo. - If you look closely at the Orbit's logo, you’ll notice that the capital “O” is split into 2 parts: one dark and one light. In the background you can see the image of an orbit. So, it’s clear that the “O” symbolizes day and night and a planet revolving around the Sun. When Should I Trademark My Name or Logo? - All Up In Yo' Business
Contact Aiden and learn more at www.180lawco.com. Someone asked me recently when is the best time to trademark your business name or logo. The simple answer: As soon as possible! Really, in general, the sooner the better for filing a trademark for your business name or logo. I discussed in a previous video that you have some trademark rights under common law even if you never register it with the U.S. Patent and Trademark Office (USPTO). But, having a registered trademark is infinitely better and it makes your trademark rights a lot stronger. So, even though you might have a common law trademark in something, its always better to actually register the trademark if you can. To register a trademark, you do have to be actively using whatever the trademark is in commerce. So, if your business is already established, i.e., you have a website or marketing materials using your business name or logo that you are trying to trademark, then you are actively using it in commerce and that will work in your favor when you try to get it registered. If you’re not quite there yet, for example, maybe all you have so far is a great logo, you can still file an application for the trademark. However it is an “intent to use” application… and it is exactly what it sounds like. It means that you are intending to use whatever the trademark is. So, that will buy you some time in being able to actively use that trademark in commerce, but still getting that protection if your trademark is ultimately registered. So, even if your business is not actively started yet, you can, in most cases, still file that intent to use application to get a head start on that trademark registration. So, simply put, the sooner you can file a trademark application, the better off you are. It basically gets you first in line in priority of using that trademark, assuming no one else has already used it. And if you are still getting your business started, you can file that intent to use application in order to get a little extra time for you to start using it actively in commerce. Foundr Magazine Podcast EP114: What it Takes to Build America's Largest Wine Brand, With Barefoot Wine's Michael Houlihan & Bonnie Harvey When you think about wine, you most likely imagine stern-faced sommeliers, or parties where tuxedos and hors d’oeuvres on silver platters are the norm. Michael Houlihan and Bonnie Harvey do not fit the stereotype. You probably wouldn’t even expect them to be wine-lovers, let alone the co-founders of Barefoot Wine, the largest wine brand in the world. But according to them, the reason they’re so successful is precisely because they knew nothing about the industry going in. Houlihan and Harvey never planned on going into the wine business, but when the opportunity presented itself, they jumped on it. “If we had known then what we know now, there would be no Barefoot Wine. It’s now the largest wine brand in the world, but it would not exist if we had a clue,” Houlihan says. Not having a clue turned out to be their secret ingredient. Instead of being influenced by years of tradition and trying to fit the mold of the wine industry, they decided to do something different and make wine fun and accessible to the average person. Despite the backlash and criticism they received, despite the fact that they had no established brand or marketing presence, they found a strategy that led them to become one of the fastest-growing wine brands in the nation. To make it even more impressive, it was all achieved without paid advertising. “It was by contributing to the community, by supporting the same issues that our shoppers were interested in, that we were able to sell our product. Because we weren’t paying for advertising, this became our form of advertising. It’s what we called ‘Worthy Cause Marketing,’ and that’s what we used throughout the nation when we started to spread the word and grow and expand,” Harvey says. Barefoot Wine has come a long way since its inception in 1986, when Houlihan and Harvey naively thought they would make a profit within four years.
