Understanding the H3H3 Lawsuit
A recent lawsuit filed by Matt Hoss, better known as "The Bold Guy" against the reaction channel H3H3 has gotten YouTube's attention and even further raised the interest in fair use issues on the channel. I decided to take my own deep dive into the lawsuit, understand what is going on and try to make sense of what is going on and what the likely outcomes are. When Public Domain is NOT Public Domain - The Story of Carol Highsmith
When is a public domain image not in the public domain? When you can be told you owe a license for it. Carol Highsmith is a famous photographer who, for nearly the past 30 years, has dedicated her photos to the Library of Congress to be placed in the public domain. Imagine her surprise when a stock photo agency hit her with a demand letter over one of her own images that was also in the public domain. Highsmith is suing Getty Images over this but the path of the case is not a clear one. Even worse, it could have a major impact on YouTube, with so many YouTubers dependent on public domain images, audio and video (myself included). Why Night of the Living Dead is Public Domain
Night of the Living Dead is one of the most famous horror films of all time. It's also completely copyright free, at least in the United States. To understand why it is we have to look at the production of the film, the Copyright Act of 1909 and how a very, very stupid mistake caused the film to never spend a single second with copyright protection. But don't feel too bad for the film's creators, suffice to say, they went on to do some pretty cool things elsewhere (that did enjoy copyright protection). H3H3 Lawsuit Update: Defamation Claims
The H3H3 lawsuit is still moving forward and, by moving forward, I mean moving backwards. The motion to dismiss has been, well, dismissed voluntarily and a new complaint has been filed along with a new response. What we do have though is a new claim in that complaint: Defamation. That's right, Hoss is now claiming that H3H3 productions defamed him in their videos. Though he's fairly vague about what exactly was defamatory, he pointed to a great deal of hateful and vitriolic comments as damages. Understanding Capitol Records v. Vimeo
While much of YouTube was distracted by lawsuits involving H3H3 and other YouTubers, another lawsuit with potentially serious consequences was ongoing and recently saw a major ruling. Explaining the Oracle v. Google Case

The Bizarre Copyright of Doctor Who
Doctor Who is one of the longest running and most-beloved science fiction series of all time. However, it's also got one of the most bizarre copyright histories too. Due to a fluke in the way the original episodes were written, many of the series' most famous characters remain under control of their original creators, not the BBC. Another YouTube Copyright Lawsuit - Lewis Bond (Chriswell)
Even as YouTube is still dealing with the fallout of the H3H3 lawsuit and the creation of FUPA, yet another copyright infringement lawsuit has been filed against a YouTuber. This one targets film buff Lewis Bond, known on the site as Chriswell, has been sued by Serendip LLC, the company that holds the rights to compositions by Wendy Carlos. Carlos created compositions for films by Stanley Kubrick and Bond created a mini-documentary exploring Kubrick's work. So, once again, we find ourselves taking a deep dive into a YouTuber's lawsuit and try to understand what happened, where the lawsuit is going and what is likely to happen next. All in all, this is yet another cautionary tale for YouTubers, especially those who want to create new works based on what others have made before. Who is Merlin CDLTD?

Update on the Matthew Santoro Plagiarism Scandal
The Matthew Santoro plagiarism scandal continues to unfold as Santoro adds attribution to all of his videos (a good first step) but still has not offered a real apology or even a good explanation for why the citations weren't there to begin with. The continuing saga of the lawsuit against H3H3 took an uplifting turn when the YouTube community rallied around them, even after they didn't ask for support, and raised more than $100,000 to allow them to litigate the case (and support others who may be similarly threatened).
